{"id":5749,"date":"2013-10-07T12:21:22","date_gmt":"2013-10-07T10:21:22","guid":{"rendered":"http:\/\/korolko.pl\/?p=5749"},"modified":"2019-10-07T12:51:44","modified_gmt":"2019-10-07T10:51:44","slug":"amended-provisions-on-community-trademark","status":"publish","type":"post","link":"https:\/\/korolko.pl\/en\/blog\/amended-provisions-on-community-trademark\/","title":{"rendered":"Amended Provisions on Community Trademark"},"content":{"rendered":"<div class=\"nolwrap\"><p style=\"text-align: justify;\">The European Commission has prepared draft amendments concerning the Council\u2019s directive No. 2008\/95\/WE, aiming at approximation of the EU member states\u2019 legislations on trademarks as well as the regulations of the Council of the European Community No. 207\/2009 on community trademarks. The content of the abovementioned drafts implies among others that the legal regime will be soon short of the name \u201cOffice for Harmonisation in the Internal Market (OHIM)\u201d.<\/p>\n<p style=\"text-align: justify;\">That will be replaced by the \u201cEuropean Union Agency for Trademarks and Models\u201d. According to the planned changes, the requirement of \u201cgraphic representability of a trademark\u201d will be removed. It is assumed that using a protected trademark as a trade name will be deemed as an act of infringing nature provided the criterion of use with respect to goods and services has been met. Statutory clearance will consider only categorical premises for trademark protection, whereas relative premises will be subject to scrutiny undertaken at the opposition proceeding stage upon a motion by the earlier rights holders.<\/p>\n<p style=\"text-align: justify;\">The Polish Chamber of Patent Attorneys attaches particular importance to the draft amendments to the directive for it has a direct impact on the EU member states\u2019 internal systems, including the legislation of our state. The declared objectives of the directive are among others to:<\/p>\n<ul>\n<li style=\"text-align: justify; margin-bottom: 6px;\">achieve greater approximation of national regulations and procedures concerning trademarks in order to increase their integrity with the community trademark system by implementing further substantive law provisions as well as introducing into the directive primary procedural provisions, in compliance with the stipulations of the EC Council\u2019s regulations,<\/li>\n<li style=\"text-align: justify;\">facilitate cooperation among the respective EU member states\u2019 offices of the OHIM (in the future \u201cthe European Union Agency for Trademarks and Models\u201d) in order to ensure practices harmonization and development of shared tools by establishing the legal grounds for such cooperation.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Therefore, on 11 September 2013, at 11 a.m., in the seat of the Polish Chamber of Patent Attorneys, a joint meeting will be held by the Committee of Legislation and the Committee of International Cooperation of the National Chamber of Patent Attorneys, open for all members of the Chamber. Based on the outcome of internal discussions, the Committee of Legislation and the Committee of International Cooperation will prepare a statement, which will be presented by the representatives of the National Chamber of Patent Attorneys in the course of the forthcoming meeting in the Ministry of Economy, which is to be held in order to discuss the ways of facilitating the system of trademarks registration in the EU.<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>The European Commission has prepared draft amendments concerning the Council\u2019s directive No. 2008\/95\/WE, aiming at approximation of the EU member states\u2019 legislations on trademarks as well as the regulations of the Council of the European Community No. 207\/2009 on community trademarks.
