Statute of Limitations for Sale Contract Usually Amounts to More than 2 years

According to Article 554 of the Polish Civil Code, claims based on sale made within the scope of operations of the seller’s enterprise become barred by the statute of limitations after two years. However, in some cases, the statute of limitations may be almost 3 years,

Within the amendment in 2018, known mostly of shortening a 10-year period of statute of limitations to 6 years, to Article 118 of the Civil Code was added the following sentence: “However, the term of statute of limitations ends with the end of calendar year, unless the statute of limitations is shorter than 2 yeras”. Due to that change, almost in every case the statute of limitations for sale contract concluded within business activity, amounts to more than 2 years. In the extreme case it may last even almost 3 years – if the statute of limitations period started in the beginning of calendar year.
