Electronic Applications to National Court Register Delayed
In connection with the entry into force on February 12, 2021 of the amendment to the act of January 26, 2018 amending the act on the National Court Register and certain other acts (Act of January 21, 2021 amending the act – Code of Administrative Procedure and some other acts; Acts; Journal of Laws of 2021, item 187), the deadline for implementing electronic services for the National Court Register has been postponed.
Electronic filing of applications, as well as electronic access to the files of the National Court Register, was to be possible from March 1, 2021, however, due to the introduced changes, this date was postponed to July 1, 2021. From that date, all applications to the National Court Register will be obligatorily submitted via the electronic system, and the submission of documents in paper form won’t have any legal effects. Electronic documents will require a trusted e-PAUP signature or a qualified electronic signature. What’s more, the forms provided in digital version will be able to verify the completeness and correctness of applications while filling them in, which should positively affect the acceleration of the registration process.
The created teleinformation system is also to enable viewing of registration files, which in turn will facilitate and speed up access to collected registration documents.
It is also worth bearing in mind that even now it is possible to submit applications to the National Court Register electronically by the PDI system – Access and Information Portal, which not all entrepreneurs know about. In the case of companies that were created using the S24 Portal (i.e. general partnerships, limited partnerships and limited liability companies), you can also report changes by this portal, as long as we have not previously registered any changes using paper forms. However, with the help of the PDI system, you can make changes in all types of companies that are subject to entry in the National Court Register.
It should be mentioned that work on the full electronicisation of the National Court Register has been carried out for a long time, the decision on the date of implementation of the relevant regulations has been postponed several times, so whether 1 July 2021 will be the date of final implementation of this solution, time will show.
