The Law Firm’s activities within the scope of Antitrust and Competition Law are aimed to ensure that our Clients’ conduct is in compliance with domestic and EU competition regulations. The Law Firm assists its Clients in all various actions undertaken to defend their interests against infringements by third parties. This includes pre-litigation actions as well as Clients’ representation before courts of all instances. In particular, the Law Firm provides:
- on-going analysis and assessment of commercial undertakings in terms of their compliance with competition and consumer protection laws, as well as the Act on Combating Unfair Competition,
- elaboration of internal procedures for business entities, aimed at ensuring their business conduct compliance with the competition law and the regulations on consumer protection,
- assistance in making antitrust notifications on intended business concentration to the Competition and Consumer Protection Office concerning planned mergers and other capital or commercial transactions,
- legal counselling on all aspects of conduct under the Competition and Consumer Protection Act, in particular related to abuse of the dominant market position as well as concluding agreements and undertaking practices which may prove anti-competitive,
- legal advice on EU competition laws, including anti-competitive conduct and agreements,
- reviews and drafts of commercial agreements to ensure their compliance with competition laws,
- assistance in negotiations and court proceedings aimed at discontinuation of unfair competition practices,
- Clients’ representation in antitrust proceedings,
- legal opinions on advertising and promotional actions in order to eliminate accusations of anti-competitive practices.
