Employees in Isolation May Perform Remote Work
On the basis of the act of November 27th, 2020, on change of the special solutions related to the prevention and combating of COVID-19, other infectious diseases and crisis situations caused by them and some other acts, during the epidemic state in Poland, employees subject to obligatory isolation at their homes, since December 5th, 2020, upon the employer’s consent, may remotely render work determined in their employment contract preserving the full remuneration.
In the explanatory memorandum to the act, it was indicated that the regulation is aimed at giving employers possibility to continue activity when SARS-CoV-2 infections were increasing.
It has to be noted that the above regulation concerns only infected employees which don’t have any symptoms of SARS-CoV-2. When an employee is not able to perform work due to COVID-19, it should be considered as sick leave and such employee should receive remuneration or sickness allowance.
